Zamindari Land vs Freehold Land – Farak Kya Hai? Pehle Samjho

- Zamindari Land (Bhumidari/Intermediary Land): Socho aap kisi ki zameen par kirayedar ho. Aap zameen use kar sakte ho, kheti kar sakte ho, lekin aap uske asli maalik nahi ho. Freehold Conversion Ka Full Process – Step by Step Guide
Yeh process state-wise thoda alag ho sakta hai, kyunki land revenue state subject hai. Lekin overall process almost similar hi rehta hai. Main aapko general process batata hoon.
Bina documents ke toh kuch nahi hoga bhai. Yeh list pakka maintain karo:
- Zamindari Land Records (Khatauni/Khasra): Apne zameen ka latest khatauni ya khasra nakal. Yehi sabse important document hai jo batata hai ki zameen aapke naam ki hai.
- Khatedari/Malikana Haq Ka Proof: Koi bhi purana document jo prove kare ki aap ya aapke purvaj zamindari abolish hone ke baad se zameen ko cultivate kar rahe hain ya use kar rahe hain.
- Lagaan Ki Receipts: Agar aap lagaan (land revenue) bhar rahe hain, toh uski saari purani receipts. Yeh sabut karti hain ki aap sarkar ko paise dete aaye ho.
- Identity Proof: Aadhar Card, PAN Card, Voter ID – kuch bhi.
- Address Proof: Jo bhi latest address proof hai.
- Affidavit: Ek affidavit banwana padega jismein aap likhenge ki aap hi zameen ke asli khatedar ho aur aapko kisi se koi legal issue nahi hai.

Step 2: Application Kaise Banaye Aur Kahan Submit Kare?
- Form Le Aao: Apne ilake ke Tehsil Office ya Collectorate Office mein jaayein. Wahan Land Records Department ya Revenue Department mein puchenge. Unse “Zamindari to Freehold Conversion” ka application form mange.
- Form Bharo: Form ko ache se bharna. Koi bhi galti mat karna. Agar samajh nahi aa raha, toh kisi vakil ya local property dealer ki madah le lo. Woh experienced hote hain.
- Attach Documents: Saare documents list mein diye hue, form ke sath attach kar do.
- Fees Deposit Karo: Iske liye aapko ek conversion fee deni padegi. Yeh fee aapki zameen ki market value ke hisaab se hoti hai. Kisi bade sheher mein toh bahut zyada ho sakti hai, gaon mein kam. Office mein pata chal jayega.
- Receipt Le Lo: Application submit karne ke baad, ek receipt zaroor le lena. Usmein tracking number hoga. Future mein aap isi number se apne application ki status check kar sakte hain.

Step 3: Sarkari Daur-Dhoop – Patwari, Tehsildar Aur Naib Tehsildar Ka Safar
Ab aapki application process shuru ho jayegi.
- Patwari Ki Report: Sabse pehle, patwari aapki zameen par physical inspection ke liye aayega. Woh dekhega ki zameen par koi illegal kabza toh nahi hai, boundaries sahi hain ya nahi. Woh apni report tehsildar ko bhejega.
- Tehsildar/Naib Tehsildar Ki Hearing: Ek date fix hogi hearing ki. Aapko tehsildar ya naib tehsildar ke saamne present hona hoga. Woh aapse kuch simple sawal puchenge, jaise “Aap kitne time se zameen use kar rahe ho?” ya “Koi legal dispute toh nahi hai?”. Seedha-saada jawab dena.
- Objection Period: Kuch dinon ke liye aapki application ko public ke liye display kiya jayega. Agar kisi ko koi aapatti hai aapki zameen ke conversion par, toh woh aapatti kar sakta hai. Agar koi aapatti nahi aati, toh process aage badhti hai.

Step 4: Aakhri Hurdle – Conversion Order Aur Mutation
- Conversion Order: Agar sab kuch theek raha, toh District Collector ya unke dwara authorized officer aapko freehold conversion order jari karenge. Yeh ek official letter hota hai jo kehta hai ki ab aapki zameen zamindari se freehold mein convert ho gayi hai.
- Mutation (Dakhil-Kharij): Ab aapko is conversion ko apne zameen ke records mein update karna hoga. Is process ko mutation ya dakhil-kharij kehte hain. Iske liye alag se application daalni padegi patwari ke paas, jismein aap conversion order attach karenge. Fir patwari aapka naam zamindari records se hata kar freehold records mein daal dega.
Kitna Time Lagega? Aur Kitna Paisa Kharcha Hoga?
- Time: Bhai, sarkari kaam hai. Jaldi kuch nahi hota. Ideally, 6 months se 2 saal bhi lag sakta hai. Agar aapka file kisi ke table ke neeche atak gaya, toh aur bhi zyada. Regular follow-up zaroori hai.
- Cost: Ismein do tarah ke kharch hain:
- Official Conversion Fees: Zameen ki market value ka ek certain percentage. Yeh state government fix karti hai.
- Miscellaneous Costs: Stamp paper for affidavit, lawyer fees (agar liye), travel cost, photo copy, etc. Overall, zameen ki value ke hisaab se, yeh cost kam hi hai.
Kya Kare Agar Application Reject Ho Jaye?
Ghabrayein nahin. Rejection ke reasons bataye jayenge. Koi document missing thi, ya koi dispute hai. Aapko ek appeal file karne ka haq hai. Higher authority ke paas ja sakte hain. Legal advice le sakte hain. Har baar last option court bhi hai, lekin woh bahut time-consuming aur costly hai.
